Lost Earnings - Employment


Damages sought in employment actions can stem from a number of claims.  The most common are specifically addressed in the following pages:

  • Wrongful Termination - Loss of employment often leads to many complications for the plaintiff, which in turn requires special considerations for analysis of the potential loss of earnings.  These complications include time to find reemployment, time to return to the plaintiff's former level of earnings, loss of retirement accrual for long-term employees, and many other considerations.
  • Employment Discrimination - Alleged discrimination in the workforce lends itself to two forms of vocational economic analyses.  Quantification of the lost earnings due to discrimination is once again unique, requiring determination of the compensation not awarded.  In addition, many discrimination cases benefit from a statistical analysis of employment practices to prove or disprove liability.
